TERMS AND CONDITIONS OF SALE FOR BUSINESS-TO-CONSUMER SALES
The following terms and conditions of sale and delivery are applicable upon purchase of products on www.michala.dk.
www.michala.dk belongs to Michala I. S. Nielsen, VAT no. 25013182, Limfjordsvej 32, DK-2720 Vanløse, Denmark. Tel. +45 28 91 97 77, e-mail address email@example.com.
The agreement of purchase can be made in the following languages: Danish, English.
No fees will be charged by payment made on www.michala.dk.
The full amount of the purchase will be deducted before initiation of the order processing, since both standard products and customised products are only produced by the time of the purchase. No larger amount can be withdrawn than the one approved by you at the purchase.
Customised products are non-refundable. Customised products are products defined by the customer, such as linen, sheets, bed covers, pillows etcetera with special dimensions or combinations of colours and patterns chosen by the customer.
Customised products are delivered within four weeks in Denmark after receipt of the order. Products from the standard shop are delivered within two weeks in Denmark. In case the standard products are not on stock by the time of the purchase, the expected time of delivery will be within three weeks in Denmark. We will contact you as soon as possible with further information. By delivery abroad our reservations are that the delivery time may be slightly longer.
Orders amounting to more than DKK 1000 are shipped free of charge in Denmark. All prices include VAT and other taxes in Denmark. Orders worth less than DKK 1000 are subject to a freight fee. Price list for freight.
4. There is no right of cancellation for customised products from Your Customized Shop
No right to exchange the goods prevails with regards to customised products such as linen, sheets, bed covers, pillows etcetera with special dimensions or combinations of colours and patterns are chosen by the customer.
5. Right of withdrawal for products in Your Standard Shop
You have the right to withdraw from a purchase agreement without any reason within 14 days following the purchase when shopping on michala.dk. The withdrawal period expires 14 days after the date of physical delivery to you or to the person chosen by you as the receiver (not the freight operator). The right of withdrawal is met by sending your message that you withdraw from the purchase before the withdrawal period has expired.
You withdraw from the purchase by informing us that you withdraw. You can send an email to firstname.lastname@example.org communicating that you withdraw from the purchase. Additionally, it is possible to contact us via telephone at no. +45 2891 9777.
In the case that several products are in the same purchase order and it is not possible to deliver all products at the same time, the withdrawal period will start on the date of physical delivery of the last product to you or to the person chosen by you as the receiver (not the freight operator).
In case the withdrawal period expires on a holiday, Saturday, on the Constitution Day (June 5th) in Denmark, on December 24th or on the 31st of December, the withdrawal period is extended until the following workday.
You could use the standard form for withdrawal on https://www.retsinformation.dk/Form…, although this is not mandatory. In case you do so, we will immediately acknowledge receipt of your withdrawal via email.
5.1.Label for return of products purchased in Your Standard Shop
In case you are withdrawing from the purchase of a product you must send or deliver the product to MICHALA, Limfjordsvej 32, DK-2720 Vanløse, Denmark – with no excessive delay and no later than 14 days after your message to us, that you wish to withdraw from you purchase. The withdrawal deadline is met if you return the products before expiration of the withdrawal period lasting for 14 days.
The customer must bear the cost of freight for the product in case it must be returned.
Products cannot be sent to be paid on delivery, nor can they be sent without delivery.
In case you withdraw from purchases we will refund all payments to you in this connection, including any cost of freight. However, in case you chose a way of freight which is more expensive than the least expensive way of delivery offered by us, we will not refund the additional expenditure.
We will refund the amount when we have received the products returned by you.
The amount will be refunded to your bank account when we have received the returned products and controlled that the regulations for withdrawal have been met. The amount will be returned to the credit card applied for the purchase, or to a different account in case of such instructions. The precondition is that the invoice or a copy hereof is forwarded.
5.3 Testing the product and packaging
You are solely responsible for potential impairment of the product due to handling of the product differing the necessary handling in order to determine the type, characteristics and functionality of the product.
Under normal circumstances the product may be examined in the same way as it would be in a shop, but you may not start using it.
If the product was utilised in a way which would not be allowed in a shop, making it impossible to sell the product at full price again, you must expect deduction of the impairment from the amount to be return to you.
If the product lost its commercial value the purchase amount will not be refunded. The product must be returned in its original packaging.
Furthermore, you are obliged to ensure proper wrapping of the product upon return.
6. Right of complaint
In case the product you buy has a defect – for instance a defect of the material or manufacture – the regulations of the Danish Sale of Goods Act will govern.
Customers inspecting colours on a computer screen must bear in mind that the colour of the final product may deviate slightly from that of the screen because colours on screens can vary from one to another.
It is no defect if the product shrinks 2-5%.

You are obliged to complain about any defect detected within reasonable time.
If a product is deficient it can either be repaired, exchanged or the purchase amount can be refunded. Alternatively, the price can be reduced in case there is no replacement available for the product. Naturally the precondition is that the complaint is legitimate and that no defects are due to incorrect handling of the product.
We pay the cost of freight if the complaint is legitimate and provided that we have been contacted and asked in writing for a return label.
In case our return label is not applied we will solely refund the amount corresponding to our current cost of freight.
In case you chose a way of freight which is more expensive than the least expensive way of delivery offered by us, we will not refund the additional expenditure.
Upon arrival of the product you will receive an email confirming our receipt of the product for processing of your complaint and informing about the further process in connection with the complaint. The processing time will be significantly shortened if you attach a description of defects.
If MICHALA cannot establish any defects upon inspection of the returned products they will be returned to you again.
A receipt or invoice stating the purchase date must be sent with products returned to MICHALA. The complaint will not be processed without the receipt/invoice being forwarded.
Please note that we do not accept packages to be paid on delivery, nor can they be sent to us without delivery.
Please remember that at all times the product must be returned in proper wrapping.

8. Information on means of redress
Any dispute can be referred to the Centre for Resolution of Complaints. A complaint over a product or service purchased with us can be forwarded to the Danish Competition and Consumer Authority, Centre for Resolution of Complaints. The purpose of our registration of the above mentioned personal data is to be able to deliver the product to you.
The information is saved with MICHALA and kept for five years. The information is then deleted.
While collecting personal data via our website we ensure that this always happens with your explicit consent, so that you are informed precisely about the nature of the information collected and about the reason for this collection.
The Managing Director and the person in charge of order processing at MICHALA’s have access to the information about you which has been registered.
The person responsible for data with michala.dk is the Chief Accountant.
We do not store data in an encrypted form.
We do not transfer data in an encrypted form.
Information given to michala.dk will in no way be shared or sold to third party and no private data will be registered.
At all times you have the right to protest against the registration in case you are registered by michala.dk. Additionally, you have the right to know the nature of the information registered on you. Delivery outside the EU
With regards to orders paid and delivered outside the EU the Danish VAT will be deducted. However, please note that local duties and VAT may be collected locally. Therefore we recommend examination of local regulation prior to purchasing.
Freight & Returns
MICHALA pays the freight to customers in Denmark and all customers bear the cost of freight in case of returning the product.
If you withdraw from the purchase of a product in accordance with the rules of withdrawal you must return the product to the following address within 14 days after informing us about your withdrawal from the purchase: MICHALA, Limfjordsvej 32, DK-2720 Vanløse, Denmark.
The customer pays for the freight of the returned products. No freight with payment on delivery or freight without delivery is possible.
